By purchasing WordPress products from HeadThemes you confirm that you have read, understood and agreed the “Terms and Conditions”described on this page. In case there are any questions regarding these terms or if you have any pre-sales questions regarding the WordPress themes that are offered, please contact us.

1. Warranty & Liability

WordPress themes & plugins by HeadThemes are provided “as is” without warranty of any kind, either expressed or implied. The themes & plugins will work at least with the latest version of WordPress and are compatible with modern browsers. HeadThemes does not guarantee that the themes & plugins will work in all browsers, nor that the themes will be functional with all versions of WordPress, especially not outdated versions. There is no guaranteed compatibility with additional third party plugins, scripts, or other applications. HeadThemes is not responsible for the 3rd party plugins issues (supported by the theme or not). In case you are unsure about compatibility, it is recommended to contact us before purchasing. In no event shall HeadThemes be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use WordPress themes & plugins by HeadThemes .

2. Plugins License & Credits

All of our plugins are licensed under the GNU general public license (http://www.gnu.org/licenses/gpl.html). You are free to modify our plugins for personal or commercial projects as you wish to fit your purposes. Updates and support are one year after purchase. The plugins may be used on multiple personal and commercial websites. Images used for demonstration purposes in theme demos are copyrighted to their respective owners and are licensed for commercial use, adaption, modification or building upon. These images are not included with the purchase and download of WordPress plugins by HeadThemes.

3. Payments & Purchases

We don’t sell WordPress themes & plugins by ourselves. You can purchase our WordPress themes & plugins from FastSpring (Bright Market, LLC d/b/a FastSpring, 801 Garden St. #201, Santa Barbara, CA 93101, United States of America) and your contractual partner for the purchase is solely FastSpring. FastSpring is a reliable and authorized reseller of software and other digital products with focus on safe, secure internet sales and fulfillment. After your payment has been successfully processed, you will receive an email from FastSpring with your invoice. You pay an one-time charge and get lifetime access to theme updates and support and one year to plugin updates and support.  All prices are in USD currency. All prices are excluding VAT. VAT may apply to EU orders during the checkout on Fastspring page

4. Sign Up

By signing up premium users can download their purchased product zip file from their HeadThemes account page under “Downloads” section.

5. Ownership

You may not claim intellectual or exclusive ownership to any of HeadThemes products, modified or unmodified. All products are the property of headthemes.com

6. Support

HeadThemes offers fast and reliable support to customers who have purchased WordPress themes/plugins. Support is provided only via our contact form. You can find tutorials and answers to frequently asked questions in the product documentation. In addition, you can open support requests through our contact form and these requests usually will be answered within 24-48 hours during business days. Support does not include individual customizations, with the need to change the core files or custom code, 3rd party plugin issues (supported by the theme/plugin or not).

7. Delivery

Your HeadThemes product/s package will be emailed to the email address (that you will provide) once we receive your payment. Even though this usually takes a few seconds/minutes, it may also take up to 24 hours. You can contact us through our contact page if you do not receive your email after waiting for this time period.

8. Warranty

We at HeadThemes do not guarantee or provide warranty for the functionality of these templates/themes/plugins in any way. There is no guarantee for its compatibility with all 3rd party components, plugins and web browsers. You should however test the browser compatibility against the demonstration templates on the demo server. It is your responsibility to make sure browser compatibility since we can not guarantee that HeadThemes templates/themes/plugins will work with all browsers.

9. Privacy

During the order process, you are required to provide accurate personal information which will only be used to process and complete the order/payment. In addition, you can find more information in our privacy policy and the privacy policy of the particular 3rd party payment processor or reseller.

10. Refund Policy

WordPress themes/plugins by HeadThemes are non-tangible, digital goods and because of the nature of these products there are very few instances where a refund is given. If you feel that your theme/plugin is not functioning as advertised, please contact us with detailed information about your issue. From there, we’ll have a review process to determine if the theme/plugin is not delivered as promised. If we find that the theme/plugin is not working or functioning within a clean WordPress environment without the influence of 3rd party plugins, it will be fixed (refund will be given only if we can’t fix it). We encourage you to check the theme/plugin demo before purchasing a theme/plugin to determine if the theme/plugin meets your requirements. Refunds won’t be granted if the theme/plugin has been downloaded and is working as advertised.  NOTE: refunds will not be granted if you simply decide not to use the purchased products. We stand behind our products and will assist you in solving any problem you have, but we also expect you to adequately understand what you are purchasing and why.
HeadThemes digital products are subject to the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, which reads that if they have been downloaded, digital products not supplied on a tangible medium are excluded from the right of withdrawal.
